If it's a virtual program, it has to be approved by the Department of Education as a private online provider that meets the qualifications in Florida Statute 1002.45 (2) under the the "PROVIDER QUALIFICATIONS" for "Virtual Instruction Programs". You can find that statute here.
If you are uncertain whether a specific provider qualifies, you can contact your Scholarship Funding Organization (Step Up for Students or AAA Scholarship Foundation, whichever you've applied for PEP through) to ask.
You can also try requesting that your desired program apply with the DEO to be added to that approved list.

Step Up has confirmed that if a live (virtual) instruction program isn't an approved DOE provider, the instructor can try to qualify as a part-time Tutor as long as they meet one of those criteria. You can find the Part-Time Tutor criteria in the Purchasing Guide, available here.
